The Agreement Protects Both the Customer and Light Touch Technologies

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://lighttouchtech.ca website (the “Service”) operated by Light Touch Technologies (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, clients, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Contracts for Services Offered
Once a customer chooses a service of Light Touch Technologies, a contract between the customer and Light Touch Technologies is created. This contract is designed to protect both the customer and the company. Each contract is individualized specifically to the customer’s needs. Both the customer and agent of Light Touch Technologies will mutually agree to the terms of the contract with a dated and signed signature of both the customer and company. The customer’s copy of the contract is emailed in the form of a pdf to the email account of the customer before or shortly after the service is purchased and activated.
Web Design Conditions
- Quotes and Estimates: The price the customer receives as a quote is NOT intended as the final price for the web design development. The final price may change depending on what is needed after the quote was first given to the customer. The final price constitutes all work involved at first and along the way to completion, except in the case where there is a “All Inclusive” flat rate price originally offered in the quote to the customer.
- Deposit for Web Development: A 30% non-refundable deposit is required prior to Light Touch Technologies beginning the development of the customer’s website. The remainder of the price being 70% is invoiced to the customer upon satisfactory completion of the customer’s website and they have approved the final proof of there new website.
Web Hosting Service and Server Conditions
Shared Hosting
It is understood by the customer that the web hosting service they purchase is on a “Shared” server. All server resources such as RAM and important Linux server programs installed are shared by hosting accounts that are active on the Light Touch Technologies server.
Server Shell or SSH Access
Since our web hosting accounts are on shared servers, access to the server over SSH is not allowed. This is to equally protect the interests of all of our web hosting customers on our shared hosting server.
Web Hosting Server Speed and Efficiency
Even though we offer our web hosting as “shared hosting”, our hosting server is on a blazing fast network and the powerful physical server is high capacity with unlimited bandwidth. Each shared web hosting account measures very fast with website loading in browser and processing. We guarantee 99.7% website online time. The remainder 0.3% is reserved for routine server maintenance which occurs in the early hours of 2:00 am Mountain Standard Time. The downtime only lasts about 5 minutes once or twice a month. This maintenance window does not affect search engine placement or noticable drop in website traffic. All web hosting accounts come with 30 day money back guarantee and 24/7 customer care support.
Third Party Software or Services Being Offered.
Light Touch Technologies offers some services that is provided by third parties providers. We provide support for the services and products that are third party that are provided by us. WordPress is offered by us; however, support is only offered for “Web Hosting Only” customers through knowledgebase and FAQ support pages. In order to have full support for WordPress, the customer would need to purchase the Webmaster Service with SEO or the All-Inclusive Power Server hosting package.
The third party software as service that we offer is and not limited to XOVI SEO standard and professional software. OX App Suite (for Professional Email Hosting) software that is run within our server. All software updates are performed checked and performed daily.
Third Party Software We Do Not Support
Light Touch Technologies will not provide technical support for any third party software that is not already installed on our web hosting server. For example, if a customer installs an application/software on their hosting account, Light Touch Technologies will not provide support for the use and quality of the app/software. Light Touch Technologies is NOT liable for any damages that customer’s third party software or app may cause to their hosting space and account.
Conditions for Webmaster Service and SEO Marketing
Light Touch Technologies is bound to the privacy and protection of it’s webmaster and SEO customer assets and interests. We will NOT reveal or distribute any company’s “trade secrets” or content to any third party companies or entities/individuals. Our responsibility is to be the customer’s technical agent and support for website and server changes and maintenance as well as SEO marketer for their website. In layman terms, Light Touch Technologies assumes the tasks of website changes, all technical work needed for the website and server as well as monitoring and increasing the online popularity of the customer’s website.
Illegal Activities
You may not use any of Light Touch Technologies’ services for illegal purposes. You agree to comply with any applicable local, provincial, federal and international laws, government rules or requirements. The customer agrees he or she will not be entitled to a refund of any fees paid to Light Touch Technologies if, for any reason, Light Touch Technologies takes corrective action with respect to a customer’s improper or illegal use of its services.
Light Touch Technologies reserves the right at all times to disclose any information as Light Touch Technologies deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Light Touch Technologies’ sole discretion. Spam Policy
Light Touch Technologies has a zero-tolerance spam policy. It is forbidden to send unsolicited mail from or to our servers under any circumstance. Penalties amounting to a minimum of $120.00, plus taxes, can be charged for a first offence, and penalties double for repeat offenders.
Email Delivery
Shared web hosting or reseller accounts are not designed to be used to send out large quantities of emails simultaneously. There is a limit of how many emails you can send per hour, per account. The number of emails per hour varies based on the plan you select, as described on the Light Touch Technologies website. Emails sent beyond the authorized limit will not be delivered. Mailing lists can have a maximum of 100 recipients. If you do send more than 25 emails at any given time, you must activate a “throttling” feature in your mailing application when sending, so that every delivery is delayed by a minimum of 10 seconds so as not to overcharge the server. You may not attempt to circumvent this limit by linking multiple hosting accounts together. If you would like to send larger quantities of legitimate commercial emails, please inquire with our sales team about our Professional Business Email Hosting.
You may not send emails with attachments greater than 10 MB from Shared hosting accounts. If you need to share larger files, you are encouraged to upload your files on your hosting account and email a hyperlink (“URL”) to the file.
Each customer is encouraged to keep their mailboxes cleaned up of old, redundant emails. Customers are encouraged to download or archive their emails on a regular basis using software such as Microsoft Outlook, Apple Mail, or Thunderbird using the POP3 or IMAP protocols, and deleting read emails from the server.
Web Hosting Only Service Support Conditions
If any given customer decides to only purchase web hosting without webmaster service with SEO Marketing, the customer’s support from Light Touch Technologies is only within scope of making sure the customer’s website, account and email is operational and accessible on the Internet. If the customer needs more boader support and service, then he or she is encouraged to purchase our All-Inclusive Power Server package which includes web hosting or Webmaster/SEO Marketing package along with their web hosting order.
Domain Registration Ownership
Light Touch Technologies only reserves the domain name for the customer without being owner or partial owner of the domain name. The customer is full legal owner of the domain name for the specified time of registration. After the registration process is completed, the customer will receive via email an official legal letter stating the customer as legal owner of the domain name. It is understood that from the time Light Touch Technologies reserves the domain name and the domain name being available on the Internet is 24 to 48 hours. This time frame called propagation across the Internet.
Web Hosting Reseller Accounts
We currently offer three reseller packages. The packages are called, RS-1000 Starter, RS-2000 Steller and RS-3000 Pro. Each package is sufficient to allow a reseller to provide shared web hosting to their customers within their own web hosting business. Click to read about our reseller program. The reseller program is full “White Label” which means what the reseller’s customers see is the branding of the reseller, NOT Light Touch Technologies. We provide priority reseller support to each reseller account and their customers without the reseller’s customers knowing the support was provided from us.
Responsibility of the Reseller
Each reseller customer is responsible for all of the activity and behaviors of their customers on the web hosting server under their accounts. An example of this would be if a reseller’s customer compromises security the web hosting server or abuses it, the reseller is liable according to us at Light Touch Technologies. We strongly recommend that resellers create strong customer security policies that their customer should follow.
Responsibility of Login Credentials
Each hosting customer and reseller is solely responsible for all server and software login information given to them by us. Logins to the server and server software are to be protected and NOT to be distributed to any third party companies or individuals.
Resellers are resposible for the privacy and protection of their customer’s login credentials.
Collection of Login Credentials for Customers
Light Touch Technologies only have records of customers/user’s usernames and NOT their passwords. We can not access existing customer passwords. We can only reset them for the customer if they forget their passwords giving them a temporary password. It is the responsbility of the customer to change the password to a permanent one as soon as possible.
30 Day Money Back Guarantee
If for any reason you are not satisfied with our services or products, you can receive a full refund of your purchase within 30 days of original purchase. We strongly feel that you will be satisfied with our customer support, services and products.
- Renewal of services: The renewal customers for web hosting or SEO/Webmaster do not quality for this refund after 30 days from the date of the renewed purchase for their service plan.
- New web design customers: These customers do qualify for 30 day money back guarantee within 30 days of their website being completed and invoice already paid; however, the original 30% deposit prior to design is no-refundable.
- Graphic design customers without web design: Once the customer’s graphic design is completed and sent to the customer via digital format. It then becomes their property and in their possession. The 30 day money back guarantee will NOT apply as the customer had already received the digital product and we are unable to reclaim the graphic or graphics completely.

Help Desk Support Tickets
The help desk here at Light Touch Technologies is here to provide a convenient service to its present and proposed customers. Our time frame in responding to any support ticket within our company business hours is ONE hour guaranteed. Our business hours are 9:00 am – 5:00 pm (Mountain Standard Time), Monday to Friday. Outside of these hours the response time is around 2 hours and is not guaranteed within that time. However, we try our best to respond within an acceptable amount of time.
When a customer creates a support ticket for the first time, a support account with Light Touch Technologies becomes created with a randomly generated password. The customer will be emailed their logins for their support account. These credentials can be used for support ticket follow up with Light Touch Technologies now and in the future. The support account can be cancelled at anytime by the customer.
What is Not Accepted as a Support Ticket?
Support tickets from individuals that are spam such as advertising themselves or others will NOT be tolerated, and the user’s support account will be deleted and blocked from our server. Automatic, computer generated (SPAMBOTS) support ticket submissions will be automatically blocked from our server.
Intellectual Property
The Services and their original content, features and functionality are and will remain the exclusive property of Light Touch Technologies and its licensors. Customer’s website content and emails are the sole property of the web hosting customer and or web designer.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by Light Touch Technologies.
Light Touch Technologies has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Light Touch Technologies shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms within your contract.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if the customer breaches the Terms of contract. These terms also included abusive behavior from the customer towards any of the staff at Light Touch Technologies. It is understood that no refund will be issued due to breach of contract by the customer.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you must contact Light Touch Technologies to request a cancellation or choose the “Cancel Services” in your Customer Account Panel.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Customer Property Upon Termination or Customer Cancellation
If a customer’s account becomes terminated, all intellectual property that is owned by the customer is returned to the customer. An example of this is if a web hosting customer cancels or we terminate, they will receive a backup copy of their website and emails. This backup will be electronically sent to them via a download ZIP or TAR backup file.
Denial of Service
We reserve the right to deny service to anyone who wishes to do business with Light Touch Technologies if the nature of their website is online adult and child pornography, racism content, hate, hacking sites, warez sites, illegal activity demonstrated, illustrated, written or implied, Any relation to Internet Black Market or known as Black Web. We exercise this right 100% of denial of service to these individuals.
Light Touch Technologies also reserves the right to deny service if a customer’s behavior is considered abusive to any of our support staff. We reserve the right to cancel service without refund if this condition is breached.
Fraudulent Contact Information
Light Touch Technologies has the right to deny service to any customer who provides false contact information upon doing business with Light Touch Technologies. This information is including and not limited to name, email, address or phone number.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Canada without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes to Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
